The petitioner, already in custody, seeks bail in connection with Jogapatti P.S.Case No. 464 of 2017 registered under Sections 363 and 366A/34 of the Indian penal Code and Section 8 of the Protection of Children from Sexual Offences Act.
Allegation in brief is that informant's minor daughter was kidnapped by the petitioner with the help of others. Submission is that FIR was lodged after inordinate delay of 10 days whereas learned counsel for the State submits that girl in her statement recorded under Section 164 Cr.P.C. has supported the case and also alleged that rape was committed by petitioner while in captivity and she is minor. Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.25553 of 2018(2) dt.02-05-2018 2/2 the prayer of bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same preferably within a year. If trial is not concluded within the stipulated period, petitioner may renew his prayer of bail.
