JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 13.10.2017, seeks bail in Hajipur Town PS Case No. 715 of 2017 registered under Sections 414, 467, 468, 471, 34 of the IPC and Sections 25(1-B)a, 26(ii) and 35 of the Arms Act.

The allegation in brief is that the police apprehended two youths trying to escape away on motorcycle and recovered a country made loaded pistol from the possession of Kanhai Thakur and a motorcycle from the possession of the petitioner. Learned Counsel for the petitioner submits Kanhai Thakur from whose possession country made loaded pistol was recovered has been granted bail by the court below itself, the petitioner has no criminal antecedent and is in custody since 24.10.2017. Having considered the said facts and circumstances, the petitioner, namely, Sunny Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Vaishali at Hajipur in connection with Hajipur Town PS Case No. 715 of 2017 with the condition the petitioner shall appear before the trial court on each date and in case of failure to appear on two

Patna High Court Cr.Misc. No.18179 of 2018 (2) dt.29-03-2018 consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
