2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 406, 420, 406, 420, 379/20 of the Indian Penal Code.
3. As per allegation in the FIR, four miscreants fraudulently withdrawn Rs. 51,350/- from the account of the informant by using his debit/credit card and mobile with SIM.
4. It is submitted by learned counsel for the petitioner that supplementary affidavit on behalf of petitioner is brought on record to show the details of transaction. Petitioner's wife, namely, Smt. Priyanka has returned the entire duped amount i.e. Rs. 51,350 to the informant by way of Cheque of Rs. 25,350/-
Patna High Court CR. MISC. No.70339 of 2023(2) dt.06-11-2023 2/2 and account payment of Rs. 26,000/- in his account. Petitioner is languishing in judicial custody since 26.7.2023. 5.Learned counsel for the informant has submitted that informant has received the entire amount and in this regard receiving receipt is annexed as Annexure-2 to the supplementary affidavit. Now there is no dispute.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Gopalganj Town P.S. Case No. 141 of 2023.
