Petitioner filed this petition for initiation of a contempt proceeding against the opposite parties, namely, the Chairman and the Managing Director of Bihar State Cooperative Land Development Bank (now renamed as Multi State Cooperative Land Development Bank Limited) for disobeying and discarding the order dated 26.04.2012 passed in CWJC No.403 of 2008.

The Writ Court after hearing both sides disposed of the writ petition with a direction to the respondent Bank to pay the remaining post retiral dues payable to the petitioner strictly in accordance with the list prepared and maintained by the Bank

Patna High Court MJC No.3196 of 2017(8) dt.27-02-2020 2/2 for payment of its retired employees in chronological order. In accordance with chronological order, the payments of the head of provident fund, gratuity, group insurance have already been made to the petitioner but the arrears of salary and leave encashment are yet to be paid to the petitioner. Learned counsel for the petitioner submits that in the head of gratuity and provident fund, less amounts are paid to the petitioner. Therefore, the petitioner may represent before the authority, who shall dispose of the representation of the petitioner within four months from the date of receipt of this order. Since the turn has not come for payment of arrears of salary and leave encashment, therefore, no payment is made to the petitioner. The Bank is directed to pay the leave encashment to the petitioner on his turn. Since the turn for payment in the head of arrears of salary is yet to come, I find no further action is required to be taken.

Accordingly, this contempt petition is disposed of with the aforesaid liberty. If the petitioner is not paid as per his turn, the petitioner may again move this court. (Prabhat Kumar Jha, J) Harish/- U
