After some arguments, learned counsel for the petitioner submits that in view of the fact that the trial of the petitioner has proceeded and four out of six witnesses have already been examined as also informed by the learned counsel for the opposite party no. 2, the present application has become infructuous.

3. The petitioner is thus permitted to withdraw the present application in order to raise all his arguments before the court concerned at the appropriate stage.
