2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 342 and 376 AB of the Indian Penal Code and Section 4/6 of the POCSO Act, registered in connection with Dhaka P.S.Case No. 46 of 2024.

3. According to allegation, the petitioner committed rape upon six-year-old girl.

4. The prayer for bail of the petitioner was earlier rejected by this Court under order dated 07.10.2024 in Cr.Misc.No. 32285 of 2024.

5. Mrs. Nivedita Nirvikar, the learned senior counsel for the petitioner has submitted that fresh ground for renewal of the prayer for bail is that the informant and other material

The learned senior counsel submitted further that some quarrel had taken place between the children and the victim fell down and suffered injury. The injury which has been described in the medical report might be possible on account of fall on hard surface.

Considering the facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-Exclusive Special Judge (POCSO Case) East Champaran at Motihari in connection with Dhaka P.S.Case No. 46 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date till conclusion of the trial, and if he fails to appear on two consecutive dates unless he is prevented by extremely adverse circumstances, the court below shall be at liberty to cancel his bail bond.
