Misc. No.38020 of 2019, which has been dismissed for nonappearance of the petitioner. It further appears from perusal of the record that on earlier date also no one had appeared and thereafter the case was posted for 2.9.2019 and on that day also no one appeared. In this case earlier provisional bail was granted as such the Cr. Misc. No.38020 of 2019 was dismissed for non-prosecution. Submission of the learned counsel for the petitioner is that father of the learned counsel for the petitioner fell ill as such he could not appear.

I am not satisfied with the above submissions of the learned counsel for the petitioner but considering the fact that

Patna High Court CR. MISC. No.67622 of 2019(2) dt.23-10-2019 2/2 application is for grant of anticipatory bail to the petitioner, this application is allowed and the Cr. Misc. No.38020 of 2019 is restored to its original position .

Put up Cr. Misc. No.38020 of 2019 for admission and no further indulgence will be given to the petitioner in that case. (Vinod Kumar Sinha, J) chn/- U T
