Petitioner, already in custody, seeks bail in connection with Saharsa Sadar PS Case No.802 of 2017, registered under Sections 341, 323, 379, 385, 307, 324, 504 and 506/34 of the Indian Penal Code.

Allegation in brief is that due to dispute over the drainage, the accused side assaulted the informant's side and specific allegation attributed against the petitioner is of giving a khanti blow over the head of sister-in-law of the informant. Learned counsel for the petitioner submits that both sides are next door neighbours, there is case and counter case over the dispute relating to flow of water of drainage and there is no allegation of repetition of blow against the petitioner and

Patna High Court Cr.Misc. No.25570 of 2018(2) dt.27-04-2018 2/2 he has clean antecedent.

Having considered the aforesaid facts and circumstances, petitioner Shailendra Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa Sadar PS Case No.802 of 2017.
