====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-10-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Nautan P.S. Case No. 624 of 2018 registered under sections 295(A) IPC and 11(A),(B)(C)(i) & K. Prevention of Cruelty of Animal Act.

The prosecution story in brief is that one Maqsood Alam was intercepted and the cow meat was recovered from his bicycle. It has further been alleged that upon query. the arrested accused person disclosed the name of the petitioner that he brought the said cow meat from house of the petitioner. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of the statement made before the police by the arrested co-

Learned counsel further submits that the petitioner is not engaged in the business of meat and no cow meat or any incriminating material has been recovered from the house of the petitioner. Learned counsel further submits that similarly situated accused person has been granted bail by this Court in Criminal Miscellaneous No. 16642 of 2019.

Having regard to the submissions made by the parties and taking into consideration the fact that similarly situated accused person has been granted bail by this Court, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan P.S. Case No. 624 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
