JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Premchandra Yadav, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is a lady and in custody since 25.09.2017 has prayed for grant of bail in connection with Hathidah P.S. Case No. 65 of 2017 as Special No. 6413 of 2017 , registered for the offence under Section 30(A) of the Bihar Prohibition And Excise Act , 2016.

It was submitted by learned counsel for the petitioner that on false accusation petitioner was apprehended by Police on an allegation that petitioner along with one another lady after seeing Police party threwing bag containing country made liquor tried to flee away, however she was apprehended. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph no. 3 of the petition to show

Patna High Court Cr.Misc. No.55648 of 2017(2) dt.04-12-2017 2/2 that petitioner is having clean antecedent.

Considering the fact that petitioner is a lady , the nature of accusation and period of custody as well as clean antecedent of the petitioner as stated in paragraph no. 3 of the petition, let the petitioner Rina Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna / concerned court in connection with Hathidah P.S. Case No. 65 of 2017 as Special No. 6413 of 2017 .
