JUSTICE ARUN KUMAR ORAL ORDER 09-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Saharsa Mahila P.S.Case No. 11 of 2018 registered under Sections 323, 376, 448, 504 and 506/34 of the Indian penal Code and 4 of the Protection of Children from Sexual Offences Act.
Allegation in brief is that one Akhilesh Kumar and Nitish Kumar Yadav, on the point of pistol, took the girl to house of Akhilesh Kumar and both of them committed rape on alarm, girl's parents reached there and petitioner and others resisted the informant's side and asked them not to go for lodging the case.
Learned counsel for the petitioner submits that allegation of rape is only against Akhilesh Kumar and Nitish Kumar Yadav, son of the petitioner, and there is no allegation of rape
Patna High Court Cr.Misc. No.28321 of 2018(2) dt.09-05-2018 2/2 against the petitioner and he is in custody since 17.02.2018 and has no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely , Siko Yadav @ Suko Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge cum Special Court (POCSO) Saharsa in connection with POCSO Case No. 12 of 2018 arising out of Saharsa Mahila P.S.
