Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The FIR of the occurrence of dacoity is against unknown. The petitioner is in custody in this case since 23.01.2017.

Submission is that only material is confessional statement of the petitioner while in police custody in connection with some other case. The petitioner was never put on TI Parade in this case nor anything was recovered from his possession. Considering the aforesaid submission, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.23362 of 2018 (2) dt.24-04-2018 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 188 of 2017 arising out of Madhubani Town Police Station Case No. 157 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
