Petitioner is apprehending his arrest in connection with Mahindwara P.S.Case No.35 of 2019 , registered for offences punishable under Sections 30(a), (b)(c)(f), 34, 36 and 41 of Bihar Prohibition and Excise Act, 2016..
Allegation against the petitioner is of manufacturing of liquor on the land of the other accused persons. Petitioner is also named in the FIR.
Submission of the learned counsel for the petitioner is that except the information supplied by the spy, there is no other allegation against the petitioner and no recovery is from his possession or from his house or any other place as well as he has also no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Mahindwara P.S.Case No.35 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
