The petitioner apprehends her arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 307, 504, 302 of the Indian Penal Code.

Due to pending land dispute between both parties, all the F.I.R. named accused persons assaulted the husband of informant and one Raj Kumar Sah, due to which, both of them died. Allegation against this petitioner is that she alongwith other co-accused Geeta Devi, Sita Devi, Sunita Devi and Priyanka Devi assaulted the informant (Anita Devi) and Neelam Devi.

It is submitted on behalf of petitioner that from bare perusal of the F.I.R., it is manifest that the specific accusation of assault is against other co-accused persons. Petitioner, being female and family member of co-accused Dinesh Sah, has been

Patna High Court CR. MISC. No.69645 of 2022(2) dt.08-05-2023 2/2 implicated with general and omnibus allegation. No specific overt act has been alleged against this petitioner. Some of the similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 02.09.2023 passed in Cr.Misc. No. 9392 of 2022 (Annexure 2 to the petition).

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Aurai P.S. Case No. 222 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
