1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115, 109, 76, 352, 351(2), 3(5) and 303(2) of the B.N.S., 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he confronted his brother as to why he forcibly took signature of mother on documents relating to land, when petitioner assaulted him by Dabiya causing injury on head and thereafter Amit assaulted by Khanti causing injury on head and he suffered three injuries on head, while Shambhu disrobed Neelam and dashed her on the ground and Kalpana snatched her chain.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that informant and father of the petitioner are own brother and are having dispute relating to property. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that he was assaulted by petitioner and Amit, on account of which, he suffered three injuries on head but then from perusal of the order impugned, it would manifest that the same records that informant received lacerated wound on the occipital region 1"x1/4" and 1"x1/4", when it is alleged that petitioner assaulted him by a sharp edged weapon i.e. Dabiya but the wound is lacerated and not incised. It is further submitted that petitioner is not a criminal and he has been implicated in the instant case with a view to coerce his father into submission.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-

No.67237 of 2025(2) dt.09-10-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Madhepur P.S. Case No.185/2024, subject to the conditions as laid down under Section 482(2) B.N.S.S.
