JUSTICE MADHURESH PRASAD ORAL ORDER 13-12-2017 Heard counsel for the petitioner and APP for the State. The petitioner seeks bail in a case registered for offence under sections 399 and 402 of the IPC as well as under sections 25(1-b) a, 26, 11, 35 of the Arms Act and under sections 20 and 22 of the NDPS Act.

Counsel for the petitioner submits that other than the confessional statement of accused, who has been arrested at the spot and from whom incriminating material has been recovered, there is nothing on record to connect the petitioner with the offence. No recovery has been made from the petitioner's possession and subsequent upon his arrest in the instant case, he has also been implicated in Sahebganj Police Station Case No. 125 of 2017 lodged on the same date. In other case disclosed by the petitioner in paragraph 3 of the bail petition, he is already on bail. Petitioner is in custody since 19.5.2017. In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the

No.56287 of 2017 (2) dt.13-12-2017 satisfaction of the Sessions Judge cum Special Judge, Muzaffarpur in Sahebganj (NDPS) Case no. 127 of 2017 on the on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
