The petitioner seeks bail, who is in custody since 30.08.2022 in connection with Barun P.S. Case No. 257 of 2022, F.I.R. dated 21.06.2022 registered for the offence punishable under Sections 302,34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that on the basis of the instruction that all the prosecution witnesses have already been examined so learned counsel for the petitioner seeks permission to withdraw this application with liberty to move a fresh application, if so advised.

Permission is accorded.
