JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-04-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has prayed for bail in a case instituted for the offence under Sections 302, 307/34 and 120B of the Indian Penal Code and Section 27(3) of the Arms Act. The allegation against the petitioner along with others is of killing the husband of the informant.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. He submitted that the informant is not an eyewitness of the said occurrence. Petitioner is languishing in judicial custody since 04.06.2022.

Learned APP for the State and learned counsel for the informant opposed the application for bail and submitted that there

Patna High Court CR. MISC. No.68530 of 2022(3) dt.13-04-2023 2/2 is direct allegation of shot fired upon the informant's husband is against the petitioner due to which he died. During investigation informant and other witnesses supported the prosecution case. From the perusal of the postmortem report, which is mentioned in vide para-46 of the case diary, the doctor opined that cause of death is due to massive hemorrhage and right lung laceration by gun shot injury.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to conclude the trial expeditiously.
