2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Ara Town P.S Case No. 348 of 2023 dated 05.05.2023 registered for the offence punishable u/ss 341, 323, 384, 448, 307 read with 34 of the Indian Penal Code and 27 of the Arms Act, 1959.

4. As per the prosecution case, the petitioner along with co-accused persons assaulted and injured the son of the

Patna High Court CR. MISC. No.71469 of 2023(3) dt.23-11-2023 2/3 informant. The accused persons chased and came to the house of the informant and the co-accused, Chandan Choudhary fired, which hit the informant's right knee.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It is further submitted the injury on the son of the informant is simple in nature caused by the hard and blunt substance and the injury on the informant beneath the right knee is nonvital part of the body. The specific allegation of firing is against the co-accused, Chandan Chaudhary. The petitioner has nine criminal antecedents out of which he is on bail in eight cases as stated in para 3 of the bail petition.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Bhojpur at Ara

Patna High Court CR. MISC. No.71469 of 2023(3) dt.23-11-2023 3/3 in connection with Ara P.S. Case No. 348 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
