ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 15.07.2019, in connection with Kargahar P.S. Case No. 90 of 2016 for the offences under Sections 394 of the Indian Penal Code. Learned counsel for the petitioner submits that in the instant case, the petitioner is not named in the FIR and the details of occurrence have been graphically stated in the FIR which clearly shows the manner of occurrence wherein the petitioner is not said to have any role. Learned counsel for the petitioner submits that the present case was lodged by the person who had been entrusted with filling up the ATM machines whereas a similar case has also been lodged by the management bearing Kargahar P.S. Case No. 91 of 2016 and in the said case,
Patna High Court CR. MISC. No.77685 of 2019(3) dt.03-12-2019 2/2 the petitioner has already been granted bail by this Court in Cr.Misc. No. 30615 of 2016 vide order dated 08.09.2016. Learned counsel for the petitioner further submits that so far as the antecedents of the petitioner are concerned, he is accused in the two cases, namely, Kargahar P.S. Case No. 90 and 91 of 2016 relating to the same occurrence. So far as the third case bearing number Kargahar P.S. Case No. 145 of 2016 is concerned, that too refers to the same occurrence. Considering the aforementioned facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Kargahar P.S.
