JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Dehri Nagar (Dalmiyanagar) P.S. Case No. 931 of 2017, dated 13.11.2017, instituted for the offences punishable under Section 414 of the Indian Penal Code.
The local police was informed secretly that two persons are moving on two stolen motorcycles. The police party could spot those motorcycles with two riders, who were found to be moving in suspicious circumstances. The aforesaid motorcycle were intercepted and one person was arrested, viz. Learned counsel for the petitioner has submitted that he has no idea as to how aforesaid Sanjay Kumar, a coaccused, has named the petitioner. The petitioner actually is a student of B.Tech. from Noida University and was not even present in the village at the time when aforesaid Sanjay Kumar was arrested by the police. It has further been submitted that it appears that there has been some confusion with respect to the name of the petitioner. It may be possible that some other Pappu Kumar would have been named by the aforesaid co-accused Sanjay Kumar. Be that as it may be, regard being had to the fact that the petitioner is a student and does not bear any criminal antecedent, he is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri in connection with Dehri Nagar (Dalmiyanagar) P.S. Case No. 931 of 2017.
