08-05-2018 Heard Sri Pushpendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent which fact has been stated in paragraph - 3 of the petition and is in custody since 27-03-2018, has prayed for grant of bail in Complaint Case No. C-2/180 of 2018/235 of 2018 registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It was submitted by learned counsel for the petitioner that on false accusation of carrying huge quantity of Nepali Saufi wine, the petitioner was apprehended and since his arrest, he is continuing in custody. It has been argued that petitioner has falsely been implicated in the present case.

No.27422 of 2018(2) dt.08-05-2018 2/2 Be that as it may, considering the nature of accusation, clean antecedent and period of custody, let the petitioner namely Mukesh Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II cum Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C-2/180 of 2018/235 of 2018.
