The sole appellant, who is in custody only since 06-01-2018 in connection with Nasriganj P.S. Case No. 208 of 2017 registered for offence under Section 364 of the Indian Penal Code, has prayed for grant of bail.
Learned counsel for the petitioner submits that F.I.R. was lodged against unknown and petitioner has been made accused only on an accusation that victim was recovered from the house of the petitioner, whereas, the family of petitioner consists of eight members and petitioner, being head of the family, has been made accused. Patna High Court Cr.Misc. No.26513 of 2018(2) dt.03-05-2018 2/2 petitioner further submits that petitioner is the Chairman of the Ward Parishad and as such, a prayer has been made for granting bail.
Fact remains that victim was kidnapped, while he was on morning walk, by a Scorpio vehicle, thereafter, during investigation, a search was conducted in the house of the petitioner, from where, victim was recovered and it appears that about Rupees five lacs of ransom money has also been recovered.
Considering the seriousness of the accusation, there is no reason to pass favourable order.
The prayer of bail stands dismissed.
