2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that from a car altogether 174.60 liters of country made liquor was recovered.

4. Learned counsel for the petitioner has submitted that petitioner was the driver of the vehicle and he was having no information regarding the alleged recovery. The petitioner is in custody since 12.08.2025

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with a condition that the petitioner shall not indulge in similar nature of offences in future. The above named petitioner is directed to be released on bail in connection with G.O. Case No. 799 of 2025 arising out of Madhubani Excise P.S. Case No. 263 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Madhubani.
