1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of D.P. Act.

3. Learned counsel for the petitioner submits that notices have been received by the O.P. No. 2 personally as would manifest from the Office Report dated 24.06.2023, it is next submitted that despite receiving notice the informant chooses not to appear nor to contest the case.

4. Learned counsel for the petitioner submits that the

No.69499 of 2022(3) dt.21-07-2023 2/2 petitioner is a person with clean antecedent and being husband has been falsely implicated in the present case and is ready to keep the informant with honour and dignity in case the informant intends to revive her conjugal relationship.

5. Since, the informant despite receiving notices chooses not to appear as such, the Court has no option but to grant the privilege of anticipatory bail to the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 2386C of 2018 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
