JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-08-2018 Learned counsel appearing on behalf of the petitioner seeks permission to withdraw this application with a liberty to avail the alternative remedy of appeal provided under Section 11 of the Bihar Public Land Encroachment Act, 1956 against the final order dated 06.10.2017, passed in Encroachment Case No. 70 of 2016-17, as contained in Annexure-H of the counter affidavit within a period of three weeks from today.
Permission is accorded.
However, it is expected from the Appellate Authority that if any appeal is filed along with an application for condonation of delay, the same may be considered in view of the fact that the petitioner was pursuing his remedy before
Patna High Court CWJC No.16753 of 2017(3) dt.20-08-2018 2/2 this Court since16.11.2017.
Accordingly, the writ application is disposed of as withdrawn with the aforementioned liberty.
