Petitioner, already in custody, seeks bail in connection with Belaganj PS Case No.187 of 2016, registered under Sections 302 and 120(B)/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

Allegation in brief is that the son of the informant was called by Sanjay Yadav, the brother-in-law of the deceased, at his in-laws place for partition of land and later on his dead body was found.

Learned counsel for the petitioner submits that the informant is not the eye witness, there is land dispute in between the deceased and Sanjay Yadav and Sanjay Yadav has been granted bail by a coordinate Bench of this Court vide Cr. Misc.

Patna High Court Cr.Misc. No.24251 of 2018(3) dt.25-04-2018 2/2 No.46331 of 2016 on 05.12.2016 and except suspicion raised against the petitioner, no other material has transpired during investigation.

Having considered the ground of parity, petitioner Mantu Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 3rd, Gaya in connection with Belaganj PS Case No.187 of 2016.
