Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 8/ 12 of the POCSO Act.

As per the prosecution case, this petitioner committed unnatural offence with the victim.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that informant, after knowing the real facts, filed a compromise petition before the court below. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.70031 of 2022(3) dt.11-05-2023 2/2 Learned counsel appearing for the State opposes the prayer for anticipatory bail and submitted that victim in his statement u/s 164 of the Cr. P. C. fully supported the prosecution case.

Considering the nature of accusation, gravity of the offence and the statement of victim recorded u/s 164 of the Cr.P.C., I am not inclined to enlarge the petitioner on pre arrest bail. Accordingly, the same is rejected.
