Petitioner, already in custody, seeks bail in connection with Jaynagar PS Case No.11 of 2018, registered under Sections 380, 34 of the Indian Penal Code.

Allegation in brief is that the petitioner was apprehended at the spot by the informant side while he was trying to commit theft.

Learned counsel for the petitioner submits that the allegation is that Rs.40,000/- and some jewelleries were stolen and two persons were said to have escaped away but the petitioner is the resident of the same village and nothing was recovered from his possession and he has no criminal antecedent. It is further submitted that the occurrence is dated

Patna High Court Cr.Misc. No.24520 of 2018(2) dt.25-04-2018 2/2 09.01.2018 and it is said that petitioner was apprehended at the spot and FIR was lodged next day but he was taken into custody on 12.01.2018.

Having considered the aforesaid facts and circumstances, petitioner Prem Das @ Prem Kumar Das @ Prem Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Madhubani in connection with Jaynagar PS Case No.11 of 2018.
