2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 329(3), 109(1), 352, 351(2), 324(4) & 3(5) of the Bhartiya Nyaya Sanhita and Section 27 of the Arms Act.

3. The prosecution case, in brief, is that on 17.06.2025 at around 11:00 P.M., the petitioner and one Manish Kumar went to the informant's house and abused him. They also allegedly fired shots into the air. When the informant shut the door of his house, both the accused persons indiscriminately fired at the door and wall, causing damage, and threatened to kill him. Upon reaching the house of the informant, police seized empty cartridges.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is general and omnibus allegation against the petitioner. It is next submitted that the informant himself is a habitual offender, and several criminal cases have been instituted against him. It is further submitted that the dispute between the parties has been amicably settled, and a compromise petition, duly signed by both parties, has been filed by the informant on 05.07.2025. Lastly, it is submitted that although the petitioner has seven criminal antecedents, he is presently on bail in all those cases and has been acquitted in Ballia P.S. Case No. 37 of 2018.

5. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioner.

Taking into account that the matter has been compromised between the parties, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai/Successor Court in connection with Ballia P.S. Case

No.66907 of 2025(2) dt.17-09-2025 3/3 No.253 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS as well as the following conditions: (i) One of the bailors should be the family member/relative of the petitioner(s) who shall provide official document to show his/her bona fide;

(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself; (iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner(s) shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Ajit Kumar, J) shikha/- U T
