2. The petitioner seeks bail in connection with Paru P.S. Case No. 425 of 2025 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, on search total 225 liters illicit liquor has been recovered from the Maijic Vehicle bearing Registration No. BR06GC 9324.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to previous criminal antecedent. He submits that total 225 liters of foreign liquor was recovered from a Maijic Vehicle. He further submits that nothing has been recovered from the conscious possession of the petitioner. He next submits that petitioner is neither the

He lastly submits that there is no independent witnesses of the seizure list rather they are the member of raiding party. Petitioner has got one criminal antecedent as stated in para 3 of the petition is in custody since 14.08.2025.

5. Learned APP for the State opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned Exclusive Special Judge, Excise-II, Muzaffarpur dated 26.08.2025, it appears that on the basis of written report of the Police-sub-Inspector namely, Ankit Kumar, FIR has been registered under Section 30(a) of the Bihar Prohibition and Excise Act against three named co-accused persons including the present petitioner. It also appears that total 225 liters illicit liquor has been recovered from the Maijic Vehicle and no any independent witnesses of the seizure list. Petitioner has got one criminal antecedent as stated in para 3 of the petition is in custody since 14.08.2025, so considering all these aspects of the case, I am inclined to grant bail to the petitioner.
