JUSTICE MADHURESH PRASAD ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under section 414 IPC and sections 4/5 of the Explosive Substances Act.

Learned counsel for the petitioner submits that on the basis of statement made by co-accused Golu kumar Mishra the petitioner has been implicated in this case, though there is no recovery from his possession and he has not been arrested from the place of occurrence. Prior to the lodging of this case, he is accused in other cases mentioned in paragraph 3 of the bail application and except for Kateya Police Station Case No. 13 of 2014, in other cases he is on bail or acquitted. Petitioner is in custody since 6.1.2016.

In the facts and circumstances of the case, prayer for bail

Patna High Court Cr.Misc. No.60373 of 2017 (3) dt.28-02-2018 of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Gopalganj Town Police Station Case No. 213 of 2015 on the following grounds:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
