JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Manihari PS case no. 512 of 2017 instituted for the offence punishable under Sections 323, 324, 307/34 of Indian Penal Code and Section 27 of Arms Act.

The allegation against the accused persons including the petitioner herein is regarding assaulting the brother of the informant by axe resulting in the brother of the informant receiving grievous injury.

The learned counsel for the petitioner submits that the present case arises out of case and counter case and the petitioner herein has been falsely implicated in the present case on

Patna High Court Cr.Misc. No.26756 of 2018 (3) dt.09-07-2018 2/2 account of continuing land dispute between the parties. The petitioner is said to be languishing in custody since 22.03.2018 and is having a clean antecedent.

Having regard to the facts and circumstances of the case, I am of the opinion that the interest of justice would be served, in case the petitioner is directed to be released upon completion of six months' custody.

In such view of the matter, the concerned court is directed to grant regular bail to the petitioner immediately upon completion of six months' custody subject to such conditions as it may deem fit and proper to be imposed upon the petitioner herein. The petition is disposed of with the aforesaid directions.
