2. The petitioner apprehends his arrest in connection with Complaint Case No. 443C of 2023, registered for the offences punishable under Sections 498A/323/504 and 506 of IPC and 3⁄4 of D.P. Act.

It has been jointly submitted that both the parties have compromised the case orally and the petitioner, according to the agreement, was to pay Rs. 1,00,000/-. He has already paid Rs. 40,000/- and Rs. 30,000/- i.e. total Rs. 70,000/-. Today, it has been jointly submitted that the remaining amount of Rs. 30,000/- has been paid to O.P. No. 2 through Cheque No.

2. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Buxar in connection with Complaint Case No. 443 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.

3. O.P. No. 2 is expected to withdraw the case and both the parties shall file suit for divorce on the basis of mutual consent under Section 13B of the Hindu Marriage Act within a period of two months otherwise she will have to return the money to the petitioner.
