The petitioner seeks bail in Special Case No.39/2017, arising out of Kankarbagh P.S. Case No.662 of 2014( G.R. No.7897 of 2014) registered under Sections 363, 366(A), 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 11.04.2017 passed in Cr. Misc. No.12536 of 2017 with a direction to the trial court to expedite the trial and conclude the same within 9 months and if the trial is not concluded within 9 months, the petitioner may renew his prayer for bail. Considering the facts aforesaid and that the trial has not yet been concluded and the petitioner is in jail since 24.12.2016

Patna High Court Cr.Misc. No.12891 of 2018 (2) dt.25-04-2018 2/2 i.e. more than one year and four months and also the victim herself disclosed her age to be 21 years, the petitioner, above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1st, Patna in connection with Special Case No.39/2017, arising out of Kankarbagh P.S. Case No.662 of 2014.
