Petitioner, already in custody since 10.3.2018, seeks bail in Paharpur PS Case No. 63 of 2018, registered under Sections 419 and 420 of the IPC and Section 44 of Information Technology Act. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated on account of altercation with the police, there is no allegation that the petitioner has withdrawn money from the account of others by using the ATM and he has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner Anish Kumar Singh @ Nitish Bhardwaj @ Guljari is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM East Champaran, Motihari in connection with Paharpur PS Case No. 63 of 2018.
