2. The petitioner seeks bail in connection with PreTrial NDPS No. 4 of 2024 arising out of Gidhaur P.S. Case No. 72 of 2024 registered for the offence under Sections 411, 412, 414, 467, 468, 471/34 of the Indian Penal Code under Sections 25(1-B)a, 26 and 35 of the Arms Act and under Sections 8, 20(B)(II) of the NDPS Act.

3. As per the prosecution case, the petitioner was the driver of the seized car caught along with other criminals which was also found to be stolen one and there is recovery of 210 grams of Ganja from the petitioner.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he is in custody since 19.06.2024. The petitioner has no criminal antecedent. Similarly situated co-accused person has already been granted

Patna High Court CR. MISC. No.76963 of 2024(2) dt.11-12-2024 2/2 regular bail by this Court vide order dated 03.10.2024 passed in Cr. Misc. No. 66311 of 2024.

5. Considering the facts and circumstances of the case, also considering the period of custody and also similarly situated co-accused person has been granted bail by this Court, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Jamui in connection with Pre-Trial NDPS No. 4 of 2024 arising out of Gidhaur P.S. Case No. 72 of 2024.

7. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the criminal antecedent of the petitioner. If the Court below finds that the petitioner has no criminal antecedent, his bail bonds shall be accepted. If the Court below finds that the petitioner is involved in any other case, his bail bonds shall not be accepted.
