JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Gardanibagh PS case no. 17 of 2018 instituted for the offences punishable under Section 414 of Indian Penal Code & 25(1-b)a/26/35 of the Arms Act.

The allegation is regarding recovery of 60 live cartridges of 7.65 bore along with mobile phone from the petitioner and one another co-accused person. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and a petition for release of motorcycle and mobile phone has already been filed by him before the appropriate authority. It is further submitted that

Patna High Court Cr.Misc. No.29426 of 2018 (3) dt.31-05-2018 2/2 though the petitioner is an accused in three other cases but he is on bail in all the three cases. Lastly, it is submitted that the petitioner is languishing in custody since 24.01.2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Patna in connection with Gardanibagh PS case no. 17 of 2018.
