The petitioner apprehends his arrest in connection with Baisi P.S. Case no. 121 of 2017, registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. The accusation is that in the evening of 18.06.2017, petitioner along with Md. Shamshir and Md. Naushad started abusing to the father-in-law of informant Md. Jamil, when informant tried to convince then they started scuffle with him. When Aaisa Khatoon and Guddu, mother and brother of the informant, rushed to save him then petitioner caused injury through Dabiya at the head of Aaisa Khatoon and when Guddu rushed to save him then Nausad caught hold him and Shamshir caused assault to him by means of lathi. Learned counsel for the petitioner submits that while
Patna High Court Cr.Misc. No.55755 of 2017 (2) dt.30-11-2017 2/2 allegation against the petitioner is that he caused injury to the mother of the informant, but the injury as found on the person of the mother of the informant is simple in nature. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Baisi P.S. Case No. 121 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
