JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-07-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

After some arguments, the learned counsel for the petitioner, in presence of Shri Alok Ranjan, AC to AAG-5, seeks to withdraw the present writ petition with liberty to file appropriate petition on the criminal side inasmuch as the order, which is being sought to be challenged in the present case is the one dated 14.06.2019 passed by the Ld. Sub-Divisional Judicial Magistrate, Darbhanga as also the one dated 01.08.2019 passed in Cr. Revision

No. 216 of 2019 passed by the Additional District and Sessions Judge-VIII, Darbhanga.

Accordingly, the present petition stands disposed of as not pressed, however, with liberty to the petitioner to file an appropriate petition under the criminal Jurisdiction of this Court and in case such a petition is filed, the petitioner shall be at liberty to mention the case for out of turn listing inasmuch as the present case is an old case and pertains to release of the vehicle in question.
