2. Petitioners seek regular bail registered for the offences punishable under Sections 190, 191(2), 191(3), 115(2), 118(1), 118(2), 109, 103, 352 and 351(2) of the B.N.S., 2023.

3. The case of the prosecution is that Md. Nizamuddin and Md. Vipat Baitha being armed with sword and 40-50 others being armed with weapon were present. It is alleged that Md. Hamid and Md. Vipat Baitha assaulted with sword due to which the brother of the informant namely, Ajay Kumar succumbed to the injuries.

4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. No specific overt act against these petitioners. It is further submitted that similarly situated co-accused persons have already been granted bail by this Hon'ble Court vide order dated 17.09.2025 passed in Cr. Misc. No. 67236 of 2025. Petitioners claim clean antecedent and they are in custody since 08.07.2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and clean antecedent, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, East Champaran, Motihari in connection with Mehsi P. S. Case No. 178 of 2025.
