2. The petitioner has preferred this application for grant of regular bail in connection with Biharsharif P.S. Case No. 379 of 2025 dated 18.06.2025 registered for the offences punishable u/ss 103(1), 238(b) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, on 18.06.2025 at 10.30 hours, the informant got information that the dead body of his daughter was recovered from a canal (pyne) near Sohsarai. Thereafter, the informant and his family members reached the hospital and identified the dead body of Puja Kumari. It is

No.67079 of 2025(2) dt.13-10-2025 2/3 further alleged that the informant's daughter was murdered with a sharp cut weapon and in order to conceal the dead body, it was thrown in a canal. It is further alleged that the co-accused, Amit Kumar enticed the informant's daughter and took her to his residence at Etwari Bazar and committed rape on her and with a view to suppress the offence, he killed her in his own room by slitting the neck and with the help of his friend he kept the dead body in a suitcase and thrown the dead body in a canal.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Amit Kumar. As per the F.I.R. the specific allegation is against the co-accused, Amit Kumar. Learned counsel has further submitted that the petitioner has accompanied by the co-accused, Amit Kumar in order to purchase of trolley bag but the petitioner has no concern with the alleged offence. It is further submitted that the witnesses have not disclosed any specific allegation against the petitioner in the alleged crime. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nalanda in connection with Biharsharif P.S. Case No. 379 of 2025.
7. The application stands allowed.
