The petitioner apprehends his arrest in Vaishali (Bailsar O.P.) P.S. Case No.106 of 2017 registered under Sections 366(A) and 363 of the Indian Penal Code.
The informant alleged that her minor daughter became traceless. During the course of search, she came to know that Saroj Kumar, Rohit Kumar and Vinod Kumar kidnapped her minor daughter. Upendra Sahni and Nandlal Sahni alleged to have helped in kidnapping the minor daughter of the informant. The learned counsel for the petitioner submits that the victim also named the petitioner along with Rohit and Saroj but victim was having love affairs with Saroj with whom she solemnized marriage.It is submitted that Rohit Kumar has been granted
Patna High Court Cr.Misc. No.55826 of 2017 (2) dt.12-12-2017 anticipatory bail vide order dated 14.07.2017 passed in Cr. Misc. No.31359 of 2017. The case of the petitioner stands on the same footing.
Considering the fact that the case of the petitioner stands on the same footing as that of Rohit Kumar who has already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No.31359 of 2017, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali(Bailsar O.P.) P.S. Case No.106 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
