====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-05-2018 Heard Sri Kumar Nikhil, learned counsel, assisted by Sri Indrajesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor.

The petitioner, husband of the deceased, has prayed for grant of bail in Barachatti P.S. Case No.559 of 2017 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the victim virtually had committed suicide. He submits that one day prior to the occurrence, she had come from her Maike ( father's home) to her in-laws house and in her Maike, some dispute had taken placed in between the deceased and her sister and it appears that due to said dispute, she committed suicide. It has

Patna High Court Cr.Misc. No.27090 of 2018(2) dt.04-05-2018 2/2 also been argued that the petitioner is in custody since 27.12.2017.

Be that as it may, considering the fact that the petitioner is husband of the deceased and death of his wife had occurred in his house as well as the fact that it was case of the prosecution that death had occurred due to strangulation, there is no reason to extend the privilege of bail.

The petition stands dismissed.
