Petitioner is seeking regular bail in connection with Gardanibagh P.S. Case No.90 of 2018 for the offence punishable under Sections 417 and 420 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegations against the petitioner is that he had been impersonating a candidate, namely, Mithun Kumar helping him out in getting selected on the post of constable. It is alleged that he was arrested because his left thumb impression did not match with the thumb impression of the candidate who appeared in the written examination. Learned counsel for the petitioner submits that the petitioner is in custody since 12.03.2018 and in similar situation

Patna High Court Cr.Misc. No.32367 of 2018 (2) dt.12-06-2018 2 /2 the co-accused persons Binay Kumar and Rajnish Kumar have been granted bail by a Coordinate Bench of this Court vide order dated 07.05.2018 passed in Criminal Miscellaneous No. 27659 of 2018.

Learned APP for the State is present.

Considering the facts and circumstance of the case and that the petitioner has remained in custody for 3 months and similarly situated accused persons have been granted bail by a Coordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna, in connection with Gardanibagh P.S.
