Petitioner seeks bail in connection with Chakai P.S. Case No. 33 of 2018 for offences punishable under Sections 273/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel is that during the course of vehicle checking and on secret information, the Tata Indigo luxury car of the petitioner was searched. Petitioner was the driver of the said vehicle who tried to flee away but was apprehended. From the car 274 liters of country made liquor was recovered.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.27751 of 2018 (2) dt.10-05-2018 2/2 petitioner that he is innocent, bears no criminal antecedent, was just a passerby and the name of the vehicle owner was not revealed neither the vehicle belonged to him and has been falsely implicated in the aforesaid case. He submits that nothing has been recovered from his possession and is languishing in judicial custody since 10.03.2018.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Jamui, in connection with Chakai P.S. Case No. 33 of 2018.
