The petitioner is languishing in custody in a case registered for the offences punishable under Sections 467, 468, 471, 420, 120(B), 34 of the Indian Penal Code.

It is alleged by the informant that this petitioner took Rs. 3 lakhs from the informant and promised to obtain the rent receipt of a land which was purchased by the father of the informant but rent receipt

Patna High Court CR. MISC. No.67984 of 2022(4) dt.19-05-2023 2/3 was not being issued. However, neither rent receipt was provided nor money was returned by the petitioner. The informant claimed that this petitioner has cheated other persons also.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The informant is a married lady and there were affairs between the petitioner and the informant and when the petitioner denied to marry with the informant, this false case was lodged against him. There is no documentary proof with regard to handing over Rs. 3 lakhs to the petitioner. The petitioner is languishing in custody since 01.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
