2. The grievance of the petitioner is only confined to expeditious disposal of Ceiling Miscellaneous Case No. 31 of 2023, pending before the Court of Divisional Commissioner, Purnea since 31.01.2023.

Learned Advocate for the petitioner contended that against the action of the official respondents by declaring the land of the petitioner as surplus, the petitioner had earlier moved before this Court in C.W.J.C. No.16739 of 2022, but the same was permitted to be withdrawn to avail the alternative remedy by order dated 19.12.2022. In compliance thereof, the petitioner has preferred Ceiling Miscellaneous Case No. 31 of 2023.

4. On the other hand, learned Advocate for the State

Patna High Court CWJC No.14895 of 2024(2) dt.07-10-2024 2/2 contended that since the matter is pending before the learned Divisional Commissioner, who shall look into the matter and dispose of the same.

In view of the submissions advanced and taking note of the nature of the relief, the writ petition stands disposed of with a direction to respondent no. 2 to take up the Ceiling Miscellaneous Case No. 31 of 2023 and bring to its logical conclusion after giving proper opportunity of hearing to all the stakeholders, preferably within a period of four months from the date of receipt/production of a copy of this order.
