JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Goh P.S. Case No. 112 of 2018 registered for the offences punishable under Sections 406, 420 and 409 of the Indian Penal Code.
As per prosecution case there is defalcation of total amount of Rs.13,67,005.29 which has been credited in the SB account of one Birendra Mishra on different dates from the account of BDO Goh and from the account of BDO, Vidhayak Kosh. It further appears that name of the petitioner has transpired in the FIR and there is specific allegation of transfer of amount of Rs.1.60 lac by the petitioner to the said account. Submission of learned counsel for the petitioner is that petitioner was Cashier and there is allegation against him to
Patna High Court CR. MISC. No.70213 of 2019(4) dt.26-11-2019 2/2 transfer of Rs.1.60 lac and he is ready to deposit the same. Heard learned APP, who has opposed the prayer for anticipatory bail on the ground that under conspiracy huge Government money was transferred to the account of different individuals by several Bank employees, including the petitioner and investigation is still going on.
In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
Accordingly, this application is dismissed.
