The petitioner seeks bail in connection with Gopalpur (Rangra) P.S. Case No. 58 of 2018 registered under Sections 30(A) and 38(i) of the Bihar Prohibition and Excise Act, 2016.

Twenty-two liters of foreign liquor is said to have been recovered from the possession of the petitioner and the petitioner was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. He has no concern with the seized liquor. He has been falsely implicated in the case at

Patna High Court Cr.Misc. No.26563 of 2018(2) dt.03-05-2018 2/2 the instance of his enemies by planting aforesaid recovery from his possession. The seizure list does not bear the signature of the petitioner. He has no criminal antecedent. He has been languishing in custody since 23.02.2018.

Considering the facts, aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Gopalpur (Rangra) P.S. Case No. 58 of 2018 to the satisfaction of the Special Judge, Excise, Bhagalpur.
